'I thought she was 13': Amish man 'busted after driving horse and buggy to meet 12-year-old girl'

An Amish man who is said to have sent hundreds of sick sexual texts to a 12-year-old girl was arrested after arranging a tryst in his horse-drawn buggy.

Willard Yoder, 21, set up a rendezvous with the child at an Indiana restaurant, according to police. But when he arrived in his buggy, he was arrested as part of an undercover police sting.

Investigators said the Amish man was co-operative and 'walked his horse and buggy around the building and tied it to a post outside'. According to a police report posted on The Smoking Gun website, Yoder claimed he contacted the schoolgirl's cell phone by chance. The report by Connersville Police Department said Yoder told his intended victim that 'the sex would happen inside the buggy'.

But it appears, the unwitting man was really communicating with the girl's parents, who had taken the phone and were posing as their daughter to try and trick him into incriminating himself. He allegedly sent about 600 texts as well as nude pictures and explicit videos.

Five of the photos apparently showed male genitals and two pictured a man from the chest area up, said the police report. 'He requested numerous times for her to send naked pictures, specifically requesting picture of her genitals. Willard advised in graphic detail that he wanted to have intercourse and oral sex' with the girl, it added.

Police launched the sting after being contacted by the parents. After arranging the meeting outside the Takehome Restaurant, police staking out the building reported they saw 'the outline of a carriage type buggy pulled by one horse and what appeared to be one occupant'.

Yoder, who said he thought the girl was 13, said he 'realised it was a bad decision and had never done anything like this before'. His parents were called to pick up the horse and buggy while Yoder was hauled off to jail and charged with four felony counts of allegedly soliciting sex from a minor. He was later freed on $200,000 bond.

The Amish are known for their simple living, plain dress and their reluctance to adopt many conveniences of modern life such as cars and even electricity in some cases. Some of the largest Amish or Mennonite communities are in Pennsylvania and Indiana.

Swiss cabinet wants to tighten prostitution law

Anyone who has sex with a prostitute under the age of 18 could face legal penalties in the future.

This is the aim of the Swiss cabinet, which on Wednesday launched the consultation period on the issue. Justice Minister Simonetta Sommaruga said it was a question of strengthening the protection of minors, which she said is "incredibly important". Currently the age of legal consent in Switzerland is 16. There are no legal restrictions on working as a prostitute or using the services of a prostitute in Switzerland from the age of 16.

While canton Geneva and now also Zurich city authorities forbid prostitution under 18 by restricting work permits, other cities and cantons are waiting for the legal age to be increased at the federal level.

Switzerland signed a Council of Europe convention last summer that requires signatories to implement such a ban. The Council of Europe Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse establishes links between demand and supply of child prostitutes by requiring criminal sanctions for both the "recruiters" and the "users".

In Switzerland pimping is illegal and uncommon: most prostitutes operate independently from small studios via mobile phones.

Turkey rape victim's lawyer raises concern

ANKARA, Turkey (UPI) -- The lawyer for a 14-year-old girl says she's concerned the 34 Turkish men accused of raping her client might receive light sentences if convicted.

The first hearing in the case was scheduled to begin Monday, Hurriyet Daily News reported. The girl's attorney, Harika Guney Harakas, said she is concerned the men will say the girl consented to sex. Harakas cited a case last year in which 26 men were convicted of sexually assaulting a 13-year-old girl. Their sentences were reduced because they said the girl consented. The attorney said Turkish law is clear that no one under the age of 15 can legally consent to sex.

In the current case, 14 of the 34 men charged were released pending trial. Two of the accused are police officers, including one who has fled the country. The girl has been in protective custody since the incident was revealed three months ago.

El Salobral murder sparks debate over minimum age of consent in Spain

Minimum ages for marriage, leaving home, working, testifying in court and consenting to sexual relations are set for a revamp, according to minister of justice Alberto Ruiz-Gallardón.

Spain's age of consent for sex is among the lowest in the world and is the youngest in the whole of Europe, and children's charities worldwide – including UNICEF and Save the Children, as well as child psychology experts – have been clamouring for it to be increased for some time.

According to the Civil Code, a child of 13 years or older is able to have a consenting sexual relationship, compared to other countries where the minimum age is 16 or 18. UNICEF and Save the Children believe it should be upped to at least 14 or 15. Being such a low age at the moment, young teenagers are open to sexual abuse by adults, the charities say.

Although the number of children either in care or under protection orders because of abuse is lower than that of northern European countries in general, including the UK – 0.6 per cent compared to one per cent – Ruiz-Gallardón has said that in the face of such serious issues there is 'no room for complacency'.

The issue has come to light once again after the death of a 13-year-old girl at the hands of her 39-year-old lover in El Salobral (Albacete). Both were well-known residents in the sleepy village (pictured) and the girl's parents did not approve of her relationship with a man 26 years her senior when she was still a child. They had reported the matter to the police when their daughter, Almudena, was 12, but she turned 13 before the police had taken any action, at which point there was nothing they could do as she was considered to have given her consent. Juan Carlos Alfaro shot her dead during an argument outside in the town square, and random shots killed a bystander who had left his house briefly for a cigarette. Almudena's grandfather suffered minor injuries in the shoot-out.

Police traced Juan Carlos to a farmhouse owned by his parents just outside the village, but he shot himself in the head when he was surrounded.

Spain may raise minimum age of consensual sex from 13 to 16

MADRID (ANSAmed) - Spain's health, social services and equality minister Ana Mato has proposed raising the minimum age of consensual sexual relations from 13 to 16. Under this age, any sexual relations are considered sexual abuse.

The proposal was made during a hearing before the Spanish Parliament's Social Equality Commission on Wednesday. The Spanish age limit is currently one of the lowest among neighbouring countries, and Mato intends to follow the recommendations of the UN Committee on Children's Rights against pedophilia and those of the Council of Europe, which hold that under the age of 15 a child cannot consent to sexual relations with an adult. The plan being drawn up by Mato has 30 objectives and is part of a broad plan approved by the Spanish government to protect children from abuse and exploitation, to be funded with a budget estimated at 5.2 billion euros over the next four years for children and adolescents and 1.5 billion to fight domestic violence.

The minister underscored the suffering many women and children are subjected to within their own homes. According to a recent study, over 80% of the victims of domestic violence and abuse do not report it to the authorities.

Spain: minimum age of consent for sex raised from 13 to 16

(ANSAmed) - MADRID - The Spanish government has completed a reform to raise the minimum age of consent for having sex from 13 to 16.

The measure is part of a draft law to be approved by the council of ministers by the end of this month. It will then be debated in Parliament for its final approval.

Under the new draft law, according to ministerial sources, an adult who has sex with a minor under 16 years of age can be charged with 'abuse' and is liable of a jail sentence of two to six years and up to 12 in case of penetration. The draft measure however provides for an exception so as not to criminalize sexual intercourse 'between equals', in particular is case of consensual sex between a minor under 16 and 'a person close to the victim in age and degree of development and maturity', as determined by a judge.

A first draft of the measure approved last October by the council of ministers set at 15 the minimum age of consent, which was then raised to 16 at the health ministry's proposal. The UN had recommended setting the age for consensual sex within the European average of 14-16.

Spain to raise minimum marriage age from 14 to 16

MADRID (AP) — Spain is moving to raise the minimum age for marriage from 14 to 16 in a bid to boost protection of minors and bring the country in line with its European Union neighbors.

The legislation was approved by the lower house of Parliament last month and was sent to the Senate on Friday for debate and likely approval over the coming months. Spanish law allows boys and girls to marry at 14 with permission from a judge. Without such consent, they must wait until they are 18.

Spain has one of Europe's lowest minimum ages for marriage in the EU, with most members setting it at 16. Ana Sastre of Save the Children in Spain, which supports the change, said the proposal came after United Nations experts in 2010 urged Spain to address the matter.

The change will affect few. The National Statistics Institute says six 14-year-olds — two boys and four girls — got married in the first six months of 2014, while just one girl of 14 got married the previous year. "Fundamentally it's a measure of protection to avert possible forced marriages, sexual exploitation or offenses against children, especially girls," Sastre said.

Ana Berrocal, civil law professor at Madrid's Complutense University, said the change was necessary given that Spain, acting on another U.N. recommendation and pressure from child protection groups, recently raised the minimum age for consent to sexual relations from 13 to 16. Javier Fajardo, law professor at the University of Navarra, said Spain's low age limits were not unusual given that, in the past, most of Europe allowed marriage once a person could have children. "Today a person of 14 is seen as still a child while a century ago they could have been the head of a family, responsible and working," he said.

China plans to boost penalties for sex with girls under 14

BEIJING (AP) -- China is planning to close a loophole that allowed some men to get away with relatively light penalties after having sex with girls under age 14, state media said Monday, following public outrage over high-profile offenders including government officials and a school administrator.

A proposed amendment to China's penal code calls for eliminating the charge of "prostitution with underage girls." If the measure is approved, any sex with girls under 14 would be considered rape and subject to harsher penalties, including death, regardless of whether the girl gave her consent. The current penalty for prostitution with underage girls is five to 15 years in jail.

The proposal has been submitted to Chinese lawmakers for consideration, the state-run China News Service said. It wasn't immediately clear when the National People's Congress would decide on the plan.

Members of the public and legal scholars have been upset that offenders are charged with "prostitution with underage girls" after being caught having sex with young girls. Compared to rape, the crime does not carry the same social stigma, and it also assigns some blame to the young victims by suggesting they use sex to seek favors such as cash, critics have argued. Advocates for children's rights say it fails to protect underage girls.

The push to change the law has gained momentum in recent years after a string of sex scandals involving young girls. In 2009, six officials in the southwestern province of Guizhou were charged with the prostitution crime after they were found to have had sex with girls who were coerced into prostitution, including three under age 14. Some men believe sex with young girls can bring them good luck such as promotions, as well as health benefits, giving rise to an underground business of pimping underage girls.

In 2013, a primary school principal was caught spending a night with four schoolgirls - all under the age of 14 - in a hotel room in southern China's Hainan province. Amid a public outcry, the principal was fired and charged with rape.

France eyes setting age for sexual consent; 13 suggested

PARIS (AP) -- A bill being prepared by the French government could set a minimum legal age for sexual consent for the first time, and the country's justice minister said Monday that she thinks 13 years old could be a reasonable age.

Justice Minister Nicole Belloubet told France's RTL radio network that age 13 was a "limit that is worth considering" for the upcoming legislation, but noted that judges should also have the ability to assess whether someone was old enough to give consent in individual situations. "The question of the age below which the minor's consent is presumed not to exist is crucial, because there are obviously extremely shocking and unacceptable situations," Belloubet said.

One of her colleagues in the French government has said that a minimum age for sexual consent has not been set for the bill. Marlene Schiappa, a junior minister for gender equality, said Sunday that the cutoff could be between the ages of 13 and 15. "Below a certain age, it is considered that there can be no debate on the sexual consent of a child, and that any child below a certain age would automatically be considered to be raped or sexually assaulted," Schiappa said on BFM TV.

Two recent court cases have heightened the debate over who is old enough to consent to sex under French law. A jury last week acquitted a 30-year-old man who was accused of raping an 11-year-old girl in 2009, French media reported. The jury in the Paris suburb region of Seine-et-Marne found that while there had been a sexual relationship between the girl and the man, it did not constitute rape according to the legal definition of the crime in France. The girl's parents reportedly found out about what had happened when their daughter became pregnant.

French media also have reported that the prosecutor's office in the city of Pontoise near Paris decided in September that a 28-year-old man suspected of having sex with an 11-year-old girl should be tried for sexual abuse instead of rape because of how French law defines rape. French law defines rape as any act of sexual penetration committed on others "by violence, coercion, threat or surprise." The definition does not distinguish between adults and minors for either the victims or perpetrators, although the potential criminal penalty is higher when victims are under 15.

A minimum age of sexual consent does not currently exist in French law. The law only says that an adult who performs a sexual act with a person under the age of 15 "without violence, coercion, threat or surprise" can be prosecuted for "sexual abuse," not rape. In both of the recent cases, investigators reportedly found that the sexual relationships did not involve surprise, threat, coercion or violence.

Sexual abuse without coercion is an offense punishable of a maximum sentence of five years in prison. A rape conviction carries a maximum prison sentence of 15 years, or 20 years when the victim is under 15 years old.

Earlier Monday, French police said they have seen a rise in reports of sexual violence and harassment amid the growing global fallout from the accusations against Hollywood producer Harvey Weinstein. An official with the French national gendarme service said it had registered 30 percent more complaints this year so far than last year, notably in October. The official wasn't authorized to be publicly named.

The gendarme service oversees security outside urban areas. Figures for cities weren't immediately available, but the gendarme data come as French women are increasingly speaking out online about past sexual abuse following U.S. revelations.
