WARSAW (Reuters) — A Polish court on Monday ordered the detention of a man accused by his daughter of keeping her imprisoned for six years and raping her repeatedly, in a case that recalled that of Austrian Josef Fritzl.

"Most probably, as a result of forced sexual intercourse ... the young woman gave birth to two children... in February 2005 and January 2007," said a statement from police in the eastern Polish town of Siemiatycze.

The police said they arrested the 45-year-old man last week after his 21-year-old daughter sought their help. No further details were immediately available but an investigation is now under way. The man was ordered held for three months pending the completion of the investigation, officials said.

Austria was rocked earlier this year by the case of Josef Fritzl, 73, who admitted he had kept his daughter imprisoned in a soundproofed basement under his house for 24 years, fathering seven children by her.

Swedish couple sentenced for raping babysitters

Published: 16 Sept 2008

A couple from Degerfors in central Sweden was sentenced to prison on Monday for sexually assaulting two teenage girls who were babysitting at the pair"s home.

According to the judgment issued by the Karlskoga District Court, the couple must pay 210,000 kronor ($31,000) in compensation to the girls, who were 14- and 15-years-old when the assault took place over the summer.

The incident occurred when the girls had been babysitting for the couple and the pair arrived home from a party. The man, who had intercourse with the 14-year-old, was sentenced to three years in prison for child rape and sexual molestation. The woman was sentenced to prison for six months for sexually molesting both of the girls, reports local media.

The couple admits to having had sex with the girls, but claim they didn"t consider the actions took place against the girls" will. In addition, the man and the woman both believed the girls were more than 15-years-old, the age of legal consent in Sweden.

RI schools required to teach about dating violence
October 5, 2008
By ERIC TUCKER
Associated Press Writer

NORTH KINGSTOWN, R.I. (AP) — Ann Burke saw signs of trouble with her daughter's boyfriend.

Image
Lindsay Burke

He'd incessantly call her at night, keep her from her family, and, ultimately, physically abuse her during a tumultuous relationship that ended with her death three years ago. Burke's 23-year-old daughter, Lindsay, may not have understood the dynamics of an abusive relationship, but her death is helping to ensure that other young people do.

Beginning with this school year, a new law called the Lindsay Ann Burke Act requires all public middle and high schools in Rhode Island to teach students about dating violence in their health classes. The initiative was spearheaded by Burke and her husband, Chris, who say schools should be obligated to teach teens the warning signs of abusive relationships and broach the subject head-on so victims feel empowered to get help and leave violent partners.

"If this could happen to her, this could happen to anyone," said Ann Burke, a health teacher who runs a memorial fund to raise money for dating violence workshops for parents and educators.

One other state, Texas, mandates unspecified awareness education on dating violence for students and parents, while several other states encourage it. But the Rhode Island measure goes further by requiring the topic be incorporated annually into the curriculum for students in seventh through 12th grade.

Burke says such education would have allowed her daughter to recognize the danger in her relationship earlier. Though her daughter left her boyfriend several times, she didn't change her phone number or have a plan for safely cutting off contact for good. She also believed she could be friends with her boyfriend if the romance ended. "I said, `No, he said that to you before, Lindsay. You can't just be friends,'" Burke recalled.

Rhode Island Attorney General Patrick Lynch, who shepherded the proposal through the legislature last year, said domestic violence is a disturbingly common crime, yet education about it is scarce and haphazard. "You teach sex ed, you teach `don't do drugs,' you teach `don't drink,' you should also be teaching `don't be a victim of domestic violence,'" said Lynch, whose office receives about 5,000 cases a year.

The law is gaining traction around the country, with members of the National Association of Attorneys General unanimously adopting a resolution encouraging the education in their states. Nebraska's top prosecutor said he intends to submit legislation modeled after Rhode Island's law, and apparel maker Liz Claiborne Inc. has helped promote it around the country.

The education focuses as much on nurturing good relationships as avoiding abusive ones. In a recent sophomore health class at South Kingstown High School, teacher Karen Murphy reviewed communication skills for friendships and romantic relationships, including waiting until you're calm before confronting someone with a problem and openly expressing your feelings.

"You've just found out that somebody spread a rumor about you and you approach them at their locker," Murphy told the class. "Are you going to want to start talking to her when you're extremely angry after you've just found out about it?"

"No," the class replied in unison.

Alex Butler, a 15-year-old sophomore, said he didn't think dating violence was a problem at his school but that the education has helped him identify stages of abusive relationships. "It's nice 'cause then you can warn other people even if you don't know them," he said.

Even if the lessons seem obvious, teachers hope students will recognize that some behaviors they may tolerate in their relationships—obsessive text messaging, for instance, or physical control—are unacceptable and possible precursors to violence. Ann Burke said Lindsay fell hard for Gerardo Martinez after meeting him at a wedding, and though he seemed respectful and nice, problems emerged after Martinez began exerting control over her daughter.

Ann Burke became so distraught that she couldn't sleep and she sought the advice of counselors. Fearing the worst, she even told Lindsay she couldn't bear to live without her. One day in September 2005, after Lindsay had moved in with her brother to get away from Martinez, Burke became concerned when Lindsay didn't answer her phone. Police found Lindsay in the bathtub of Martinez's home, her throat slashed. Martinez was convicted last year of first-degree murder and sentenced to life in prison without the possibility of parole.

Burke believes her daughter would have wanted her to teach others about dating violence. "You may have killed her physical body, but I'll be damned: her spirit is still living on in her family and friends," she said. "We're going to do what we need to do."

Rapist caught by his ring marked 'Dad'

Image
Daniel Webb's Rings (Met Police)

Jenny Booth

A rapist has been caught after his victim described distinctive rings - including one marked 'Dad' - that he wore on his hand.

Daniel Webb, of Southfields in south-west London, was wearing two gold sovereign rings and the Dad ring when he attacked a 23-year-old woman after she got off a night bus in May.

Detectives were able to match the victim"s description of his jewellery with an entry on the police intelligence database dating back to earlier dealings with the sex offender. A computer search for possible local suspects came up with Webb"s name, a court has heard.

Image
Daniel Webb was still wearing the rings when he was arrested at home less than 12 hours later

Webb, 22, of Southfields, south-west London, admitted three counts of rape, two of sexual assault by penetration and one count of robbery at Kingston Crown Court on July 16. He will be sentenced on Wednesday.

According to the Metropolitan Police, he followed his victim for about half a mile as she got off a bus near Tibbets Corner roundabout and walked towards Southfields at 4.30am on May 4. He grabbed her and dragged her into some bushes beside the road, forced her to the ground and repeatedly raped her in a 15 minute ordeal.

The victim told officers from Wandsworth CID that her attacker was a white man with a goatee beard. He was wearing gloves but took them off when he started to attack her, allowing her to notice the three distinctive rings on his left hand.

When detectives entered the word "rings" into the police intelligence database, searching for information about sex offenders locally, Webb"s name came up straight away. His home was near the scene of the rape.

Officers found Webb at home at 2pm on the same day, wearing three heavy gold rings on his left hand as described by the victim, according to the Met Police. He was arrested and the victim"s iPod was found during a search of his home.

Detective Chief Inspector John McFarlane, of Wandsworth Police, said: "The local officer performed a first rate service here, employing good observation skills and a shrewd approach that was to pay off at a later date when someone saw his comments about the distinctive rings and made a match.

"This case highlights the benefits of local policing teams, knowing the community they serve. Regular interaction between Safer Neighbourhood police teams and local criminals builds good local knowledge. Webb was rounded up in the fastest possible time as a result.

"We must also commend the victim for her bravery in this case and the way she was able to provide such a good description, despite the ordeal she had suffered. I know the knowledge that Webb is off the streets will help the victim to get on with her life and try to get back to normal."

Murdered teenager Hannah Foster made despairing 999 call after abduction

Image
Hannah Foster was found sexually assaulted and strangled after being abducted at the roadside in 2003

Steve Bird

A kidnapped teenage girl dialled 999 in an attempt to escape from her attacker but was cut off by the emergency services. She was then raped and strangled, a jury heard yesterday.

After being bundled into a van, Hannah Foster, 17, an A-level student who wanted to become a doctor, dialled the number in the hope that the operator would hear her conversation with her abductor. But because the operator could not hear what was being said, the system automatically disconnected her.

Hannah"s parents, Trevor, 57, an auditor for British Gas, and Hilary, 51, a former nurse, and her sister, Sarah, 20, were in Winchester Crown Court as Nicholas Haggan, QC, opened the prosecution case in what he said would be a distressing trial.

Image
(Mustafa Quraishi) Maninder Pal Singh Kohli is standing trial for Hannah's abduction, rape and murder

Mr Haggan said that DNA evidence would help to prove that Maninder Pal Singh Kohli, 40, a sandwich delivery driver, murdered Hannah. "He snatched her from the street. He drove off with her in his van. He found somewhere quiet and he raped her. He then strangled her and dumped her body," Mr Haggan said. "When he thought he might get caught, he fled to India."

Mr Haggan said that Hannah disappeared in March 2003 while walking home from a bus stop after a Friday night out with friends.

"At 11pm that evening, Hannah managed to use her mobile phone to contact the emergency services," he said. "She was unable to speak to the operator. It"s quite obvious from the recording that she was in a moving vehicle. In that vehicle with her was a man, and that man was speaking to her in a heavily accented voice.

"Hannah probably thought that the operator would listen to the conversation and work out that she was being held against her will."

She would not have known that there was a system to prevent accidentally dialled emergency calls from blocking up the system, he added.

Experts who analysed the recording were able to make out Hannah pretending her name was Sarah and the man saying something like: "Hold your head down, please."

Hannah"s body was discovered two days later by a 14-year-old boy in Allington Lane, West End, near Southampton. It was lying among brambles about 15ft from the road. A postmortem examination showed that she had been strangled. Although she was fully dressed, her clothing was described as "dishevelled". She had scratches on her legs, and there were traces of semen.

It is claimed that on the same day Mr Kohli was in tears as he told a friend that he needed to go to India to see his ill mother. The friend noticed a red mark under the man"s eye, which Mr Kohli is said to have claimed he got in a fight with two men. Despite Mr Kohli threatening to kill himself if his friend did not lend him money for the flight, the friend refused, the prosecution said.

The next day, Hannah"s handbag and phone were found at a recycling centre in Southsea, Portsmouth. Mr Kohli flew to India from Heathrow the following day.

A few days later, Mr Kohli"s supervisor, James Dennis, saw a recording of theCrimewatchprogramme that featured an appeal about Hannah"s murder, and contacted police. Mr Kohli"s sandwich delivery van was seized and semen stains and traces of Hannah"s blood were discovered inside, Mr Haggan said.

CCTV and Hannah"s telephone records were said to place the two together at the time of the murder.

Mr Kohli was extradited to Britain in July last year, and a DNA sample from him matched the semen found at the crime scene, Mr Haggan said.

Hannah was in her second year at Barton Peveril College in Eastleigh, where she was studying for her A levels. She had gained 11 GCSE A* passes and planned to go to medical school.

Mr Kohli denies kidnap, rape and murder.

The trial continues.

Student raped after 999 operator tells her to walk home

A judge has called for a review of how 999 calls are handled following the rape of a 19-year-old student who was told to walk home by an operator.

By Urmee Khan
22 October 2008

Taxi driver Abul Malik raped the woman when she could not pay for her fare home after she had called emergency services to report a confrontation with him. The young woman was on the way to her halls of residence with two friends. However, they left the cab only paying part of the fare, claiming they had no more money.

After a confrontation with the driver - who demanded the full £6.80 fare - the student called emergency services and asked for help. She was told the police were not a taxi service.

When she started walking, Malik, 29, followed her and offered to take her home. When she reluctantly agreed, he drove her to Brighton and raped her in the back of the taxi, Lewes Crown Court heard.

Judge Guy Anthony said the girl had been "let down in a phone call to the police" and said the controller could have done more to help. "This was a girl who gave her age, it was 3.30am, she was clearly in great distress. She complained the taxi driver was pursuing her and being horrible to her. That showed, at the very least, a lack of compassion. The least that could have been done is to say they would send somebody round."

Malik, from Portslade, denied two charges of rape and one of sexual assault. He was jailed for seven years and will be placed on the sex offenders' register for life.

Porn Star on Trial for Alleged Sorority House Rape

Wednesday, October 22, 2008

Christopher Jack Reid

COLFAX, Wash. — The trial of an amateur adult film actor accused of raping a woman at a Washington State University sorority began Tuesday.

Christopher Jack Reid, who made porn films under the name Jack Venice, is charged with rape and burglary in the attack in September of last year on a woman sleeping at the Kappa Alpha Theta sorority house.

"He told many many people that he was a porn star in town visiting," prosecutor Denis Tracy said, adding Reid allegedly told patrons of a local bar that the night of the attack he was "looking for women to have sex with me."

The alleged victim in the case identified Reid in court Tuesday. "When I looked over and saw his face, that face is something that I can't forget."

But Reid's attorney, Chris Bugbee, said that his client has been made a "scapegoat" in the case. "He's a darn good scapegoat," Bugbee said. The defense alleges that another man committed the rape. That man, Kyle Schott, is expected to testify against Reid. The trial is expected to last through Friday. If convicted, Reid could spend the rest of his life in prison.

Victim drives sleeping rapist to police station
November 5, 2008

WELLINGTON (Reuters) — A New Zealand rape victim drove her rapist to a police station when he fell asleep in his car after assaulting the woman, local media reported on Wednesday.

Vipul Sharma, 22, was found guilty of abduction and two charges of rape by the Auckland District Court Tuesday, court officials told Reuters Wednesday. The New Zealand newspaper said Sharma met the woman at an Auckland bar in 2006 and later drove her first to a park where he raped her in the back seat of his car.

After the attack Sharma allowed the woman to drive and fell asleep in the passenger seat, so the woman drove him to Auckland Central police station where he was arrested, said the newspaper. "She showed a lot of bravery and common sense. I have nothing but respect for what she has endured," police detective Simon Welsh told the newspaper.

Victim speaks out after man cleared of rape while sleepwalking

A woman has spoken out after a man accused of raping her became the latest to be cleared because he was sleepwalking.

By Alastair Jamieson
16 November 2008

Jane McKenna waived her right to anonymity to highlight her concern that attackers will increasingly use the defence that they were asleep. The 33-year-old mother-of-two has already gained the support of MPs and campaigners over the issue. She was asleep at home when a friend's husband, who had been a guest, started having sex with her.

Jason Jeal, a 37-year-old roofer with no medical history of sleepwalking, admitted sex had taken place but was cleared of rape after insisting he had been asleep and had no idea what he was doing.

Mrs McKenna said the outcome of the trial has left her feeling "shocked and degraded". She said: "It is something that has taken away my dignity. I am married and I believe that when you get married you stay faithful.

"Someone has come along and stolen something that is so important to me and it has made it difficult for me to be me, and it has made it difficult for me to have a proper relationship with my husband. I feel angry and hurt about that.

"I could find only a handful of cases similar to mine, but I want to know what the true figures are. I want to speak up for other women, I want women to come forward if this has happened to them, and I want a change in the law to stop this happening again."

Mrs McKenna's ordeal began in July last year when she and her husband invited Mr Jeal and his wife to a barbecue at their home in Hampshire.

During the evening, Mrs Jeal had an argument with her husband and went home. The McKennas then went to bed, leaving Mr Jeal asleep on the sofa downstairs. Mrs McKenna fell asleep in the same room as her nine-year-old daughter after trying to settle her but woke to find Mr Jeal on top of her.

The trial at Portsmouth Crown Court heard Mr Jeal's DNA was found on Mrs McKenna.

Mr Jeal insisted during his trial that he had no recollection of the event and Mr Jeal's barrister suggested to the jury that he had been sleepwalking at the time of the attack.

Labour MP Harry Cohen, who has introduced a Private Members' Bill to highlight the issue, said: "A rape is a rape and should be treated as such."

Mr Jeal, a father of three who has since separated from his wife, maintains he did not know what he was doing at the time of the attack.

Det Con Richard Rock, from Hampshire Police, said: "I would like to see some sort of reverse burden of proof where the defendant has to come up with evidence to prove they have a history of sleepwalking, doctors' reports, and witnesses. Otherwise anyone can simply say 'I was asleep'."

Under the Sexual Offences Act 2003, a defendant is guilty of rape if an attack is intentional.

In the case of Mr Jeal, the jury were unable to agree beyond reasonable doubt that he was awake and therefore responsible for his actions.

Well, this is just not right.

He gets away with it and she gets the message of "too bad honey, get over it" and that's that.

Maybe he was asleep and unaware and perhaps should have some leniency if this is true but without a proven history of sleepwalking, and I doubt very much that every first time sleepwalker starts raping people, I would not accept such an excuse.

Meanwhile this poor woman has no recourse. Has been violated and it is ruining her life and she just has to accept that and get on with it? No, that is not right.

Man sentenced for filming rape of his wife

3 June, 2008
Online: http://www.thelocal.se/12196/

A 41-year-old man from Eslöv in southern Sweden has been sentenced to three years in prison for raping his wife and filming the attack. He was convicted on three of four rape charges listed in the indictment.

Two video clips which police found on the man"s hard drive were key pieces of evidence in the case. The films shows sex scenes which make it clear that the crying woman doesn"t want to do what the man wants, writes the Skånska Dagbladet newspaper.

The man must also pay 166,000 kronor ($27,400) in damages to the woman.

Tokyo businessman convicted of abducting British hostess

A Japanese court on Tuesday convicted a Tokyo businessman of abducting British bar hostess Lucie Blackman but not of killing her, partly reversing a controversial earlier acquittal.

The sentence remains unchanged for former property developer Joji Obara, 56, who was given life in prison last year for raping nine other women, including causing the death of one of them. The Tokyo High Court said that Obara kidnapped Blackman, who disappeared in Tokyo in 2000. Her dismembered body was found seven months later. But the court said it could not prove that Obara killed the 21-year-old bar hostess.

"The court dismisses the first ruling," said judge Hiroshi Kadono, who then handed out a life sentence for crimes including the abduction of Blackman. A lower court last year convicted Obara for the rape of nine other women and the death of one of them, Australian Carita Ridgway. But the lower court had cleared Obara on all counts related to Blackman due to a lack of evidence.

Obara, who preyed on women in Tokyo's seedy Roppongi area, was accused of drugging his victims with chloroform, a colourless drug used as an anaesthetic in the 19th century. The Blackman case received intense media coverage in Britain and even a personal appeal by then prime minister Tony Blair. Obara was not accused of first-degree murder, so he was not eligible for the death penalty.

Romanian raped woman so he could learn English in prison

A Romanian vagrant raped and robbed a young woman in an underpass so he could be sent to prison and learn English, a court has heard.

By Paul Stokes
20 January 2009

Ali Majlat: Majlat told a prison psychiatrist he committed the offences because he wanted to go to prison where he would be fed, housed and taught English Photo: PA

Ali Majlat, 35, had been released from jail in his native country months before travelling to Britain and sleeping rough. He punched, kicked and dragged his 21 year old victim to the ground as she wait for a train at Wakefield Kirkgate Station, West Yorkshire. She managed to run off but he caught her and raped her before making off with her mobile phone, purse and bracelet last October.

Majlat told a prison psychiatrist he committed the offences because he wanted to go to prison where he would be fed, housed and taught English. He fled to London after the attack in Wakefield where he had been to visit his brother in the city's maximum security prison.

Majlat, who was arrested days later after a nationwide appeal by British Transport Police, admitted rape and robbery when he appeared at Leeds Crown Court. Judge Alistair McCallum has asked the Crown Prosecution Service to investigate Maljat's criminal history in Romania, particularly any sexual offences. He said he is considering passing a life sentence when Maljat next appears before him in April.

The judge said: "It appears he was released from prison in Romania in June 2008 then immediately came across here and presumably enters on a passport which allows him to do so under EU regulations." He wanted to know if there were any procedures in place to alert customs officers to criminals like Majlat travelling to the UK from Romania under EEC regulations. "This is going to be something we will have to be looking at more regularly," he added.

The court heard Majlat entered the UK immediately after being released from a Romanian jail last June after serving time for theft and attempted robbery. Three months later he was jailed for eight weeks by Horseferry Road magistrates in London for burglary.

Three jailed for gang rape that left girl disfigured

Steve Bird

Three men who filmed themselves gang-raping a 16-year-old girl before throwing caustic soda over her were jailed for between six and nine years.

The teenager, who has learning difficulties and a mental age of 8, was burnt so severely that she fell into a coma. Doctors feared the girl would not survive. She recovered but has been disfigured for life.

Rogel McMorris, 18, from Tottenham, North London, was jailed for nine years for rape and grievous bodily harm. Jason Brew, 19, from Haringey, North London, and Hector Muaimba, 20, from Waltham Forest, East London, received six years for rape. Two years were added to Muaimba"s sentence for an unrelated robbery. On a mobile phone recording they could be heard laughing as their victim writhed on the ground in agony, Wood Green Crown Court was told.

Stephen Bigby, who was charged with rape, was stabbed to death in a gang fight in Oxford Street before he could face trial. Three other men were cleared of all charges.

I fail to understand, reading the last 2 posts, how the Romanian man may get a life sentence for his raping the young woman while the three young men who brutally raped, threw acid on the poor disabled girl, filming and laughing the whole time, only get 4 to 6 years.

The Romanian's reasoning is completely ridiculous of course, but it's nowhere as sadistically planned and executed as what the 3 men did to the girl.

Clearly, British courts and law need better guidelines for rape crimes.
