Nurse's aide convicted of raping 92-year-old woman

CINCINNATI (AP) -- A former aide at a Cincinnati nursing home has been convicted of raping a 92-year-old resident who was confined to her bed and unable to communicate.

A judge on Monday found 22-year-old Samuel Onyenweaku guilty of the woman's Nov. 24 rape at the Amber Park Nursing Home.

A prosecutor says the woman died in February from an unrelated condition.

A nursing supervisor testified that she had tried to enter the resident's room, but the door was locked. When she finally opened it, she says she found the resident naked from the chest down and Onyenweaku in her private bathroom.

Voyeur, 30, admits raping woman, 86

A 30-year-old man from Bavaria, who crept through the streets and spied on women in their apartments, has admitted to raping an 86-year-old woman as she slept in her bed.

The father, from Nuremberg, Bavaria, admitted at the start of his trial on Monday to raping the then 86-year-old woman in July 2013 after he climbed through her bedroom window at night. His victim is still severely traumatized. The technician told the prosecution that he clambered through the window of the sleeping pensioner “to gain sexual arousal”. When the woman awoke as a result of his movements and tried to defend herself, he pressed a pillow against her face until she was unconscious.

His victim also sustained multiple fractures through the assault. The accused told the court that he was not aware of his victim's age. The victim, who is now 87, was excluded from the hearing. Her psychotherapist issued a certificate claiming that the woman was to avoid any form of agitation, and that a reencounter with her rapist could lead to a heart attack.

Describing the circumstances of his crime, the 30-year-old said he was on his way back from a barbecue. To avoid coming home to his wife drunk, he went for a walk and spied on women through their apartment windows, something he admitted to doing frequently in the past. He was, however, unable to explain how he went from being a voyeur to a rapist in the course of the night.

Tip leads to arrest in rape of elderly woman

HOUSTON, Texas - A tip to Crime Stoppers led to the arrest of a man accused of sexually assaulting an elderly woman at a southwest Houston retirement community.

The 91-year-old woman told police she was awakened about 3:30 a.m. on Oct. 1 when a man now identified as Conrad Hargest, 29, came into her room at the Creekbend Gardens assisted living center, 8106 Creekbend Drive. She asked what he wanted. "The defendant (Hargest) stated, 'I am here for the sex and the money,'" according to Harris County court documents. Houston police said Hargest held the elderly woman down while he assaulted her. Then, he took a rag from the sink and wiped her down then himself.

"The complainant said the rag was cold from the water," stated the court document against Hargest. She said Hargest then took the money from her wallet and left her room, officials said.

Security tape

Houston police interviewed the woman at Ben Taub General Hospital and later examined a security tape from the retirement center. It showed a man apparently checking for unlocked doors on all three floors of the building. He matched the description the woman gave of her assailant, Houston police said. The tape shows him stopping in an entry way at the woman's home. He then disappears from the camera for about eight minutes, Houston police said.

Claude Almaraz has lived at Creekbend Gardens for more than a decade. "This is the first time something like this has happened since I've been here. It's a good place," Almaraz said after the attack.

On Oct. 9, police received a Crime Stoppers tip identifying Hargest by name. HPD investigators questioned him at the Fort Bend County Jail, where he was being held on an unrelated home burglary charge. According to the complaint, Hargest admitted he was the person on the security video but said the tape didn't show him going into the woman's home. Detectives told him they probably will have physical evidence once the lab work is done. "The defendant said come talk to me when my DNA comes back," the complaint stated.

Increased security

Managers at Creekbend Gardens referred questions to the California-based Retirement Housing Foundation, which operates more than 170 communities throughout the nation.

RHF spokeswoman Chris Ragon said they have beefed up security since the attack, including hiring a nighttime security guard, adding an extra camera in the stairwell and re-keying all the locks in the building. She said they also installed a self-locking door latch on the woman's apartment and helped her get a medical alert device. Ragon said they will also work with the Houston Police Department to hold safety meetings with the residents. "Thank God this isn't any kind of normal occurrence for us," Ragon said.

A charge of aggravated sexual assault of an elderly or disabled person was filed last week against Hargest. He was later released from custody after posting bail on both charges, authorities said.

'Horrendous violation': Jason Jude D'Souza jailed over repeated rape of elderly widow

MELBOURNE, Australia - A judge has declared that the courts will protect the elderly in jailing a man for 14 years who preyed on and repeatedly raped a 75-year-old woman in "degrading circumstances".

In ordering Jason Jude D'Souza to serve a minimum of 10 years, Judge Mark Dean in Melbourne's County Court said that an "unequivocal message must be sent to the community that the courts will protect the elderly from offending of this nature which breaches the fundamental standards of which a civilised society is based". He told D'Souza, 39, that his conduct was cowardly and depraved, and that it had left his victim deeply traumatised.

D'Souza, who knew his victim lived alone, broke into the elderly widow's home at midnight as she slept and attacked her over a period of an hour, injuring and making humiliating remarks to her. He had pleaded not guilty but was convicted by a jury of single charges of aggravated burglary and indecent assault and to seven charges of rape committed in October last year.

The trial prosecutor Robyn Harper had earlier said in her sentencing submissions that D'Souza's crimes were a "horrendous violation" of the woman's body and her home. Ms Harper also referred to a psychologist's comments that the offending "provided a warped demonstration of his dominance" over the woman, which "both acted out his resentment towards the other women who had rejected him ..." The psychologist Patrick Newton added that it also "compensated, temporarily, for his underlying feelings of inadequacy and self-doubt".

In his sentencing remarks, Judge Dean said that earlier in the day of the attack, D'Souza visited the woman, who hugged him on leaving at his request. It was probable, he said, that D'Souza believed she would not report the offences and if she did her "reliability would be doubted by reason of her vulnerability and age". The judge said in his opinion D'Souza's parents appeared to have little or no insight into the seriousness of their son's offending and that they "gave evidence during the course of [the] trial that was intended to discredit" the victim.

Judge Dean said that on D'Souza's instructions, his barrister put to the woman that she had fabricated her evidence of being raped, a defence that was ultimately abandoned before one of mistaken identity was argued. D'Souza, who has unrelated and limited prior convictions for offences committed while drunk, has a history of depression and disrupted personal relationships, he said, and had been twice hospitalised for psychosis.

After reading a number of medical reports, Judge Dean said he was prepared to accept that at the time of offending D'Souza was experiencing some side effects from testosterone replacement therapy. He said he also accepted that D'Souza's moral culpability for his offending should be moderated to a "modest degree" because of his psychological condition at the time of offending and the "possible intensification" of it due to the therapy. In arriving at the sentence, Judge Dean said he had had "particular regard" to the principle of totality and that orders for part accumulation and concurrency ensured that it was not a "crushing" one and was consistent with current sentencing practices "for offending of this gravity".

D'Souza has already served 392 days in presentence detention.

Woman, 93, sexually assaulted in her own apartment by intruder

DEERFIELD BEACH, Fla. -- A legally blind 93-year-old woman was able to pull an alarm and summon help from neighbors as a stranger battered and then sexually assaulted her in her apartment, the Broward Sheriff's Office said.

About 2:30 a.m. Monday, the woman had taken trash to the receptacle at the end of her hall and was surprised by Clyde Alvims Leandre, 22, of Delray Beach, according to Detective Ian Kuechler. The incident happened in the Highland Gardens apartments at 331 Northeast 48th St.

Each apartment has cords near beds and toilets that activate an emergency alarm as well as a hallway light outside a tenant's door. "In her condition, with sight issues and she is technically, legally blind, she knew where to reach for that cord when she was forced upon that bed," Kuechler said during a press conference Monday at the Broward Sheriff's headquarters in Fort Lauderdale.

The alarm, her cries for help as well as the light drew the attention of three neighbors who entered the apartment through its unlocked front door, Kuechler wrote in his report. "Initially some of the other residents of the building attempted to subdue the subject," the detective said. "However, they basically explained that he seemed to have about the strength of 10 men and was oblivious to them being in the room. He continued to grasp on to the female victim and restrained her in her bedroom."

Four deputies responded to a 911 call and also tried to remove Leandre, who was not wearing pants, according to the detective's report. "He ignored their commands and he was tased," Kuechler said. "It had zero affect on him. They issued several strikes to him, again. It took four men to remove him."

Two deputies' hands were hurt and they were treated at Broward Health North and released. Leandre and the victim were admitted to the same hospital. The woman's back was injured during the incident and she was severely bruised, Kuechler said. She was discharged from the hospital Monday, according to BSO. Her neighbor Dan Magill, who lives next door, called the woman "sweet, nice and friendly."

Twila and Kennedy Green, Sr. said their friend had once enjoyed bingo games and other activities at the Northeast Focal Point Senior Center in the city. "Her vision was keeping her home," Twila Green said. "She's just a very sweet person who didn't deserve what happened. I feel bad for that."

Leandre faces charges of burglary with assault or battery; sexual assault with a weapon; false imprisonment and resisting an officer without violence, the sheriff's office said.

Highland Gardens is a 100-unit complex where residents use key fobs to enter the building's locked front door. Those already inside their homes use an intercom to open the door for guests. "It's a secure building," Kuechler said. "Ultimately the determination was made that [Leandre] had simply followed another person in who had access to the building." The detective said surveillance video was being gathered for the investigation.

The apartment building is managed by the Broward County Housing Authority, which is not a part of county government but is a special district created by the state. "We've had nothing like this before," said Ann Deibert, the authority's chief executive officer. "We're very upset that this happened. We take our families' welfare seriously and want to prevent anything like this from happening again."

The residences are for elderly and disabled people, Deibert said. There is a daytime property manager on site, but there are no security guards. A tenants meeting will be held to update residents on the situation, Deibert said. There are monthly meetings when residents are advised to not open the front door for anyone, but she also said, "We don't want to put them in harm's way. Adding security is something that we will take into consideration."

Prosecutors accuse arrested Ivorian of rape, killing

Caltagirone, Italy (ANSA) - Prosecutors formally accused Mamadou Kamara, an 18-year-old Ivorian arrested Sunday in connection with the killing of a couple in their home in Palagonia near Catania, of having raped the woman victim, Mercedes Ibanez, 70.

"The autopsy provided definite evidence that the Ivorian abused the woman," said prosecutor Giuseppe Verzera.

German court convicts man, 19, of raping 90-year-old woman

BERLIN (AP) -- A German court has convicted a man of raping a 90-year-old woman and sentenced him to 5 and a half years in prison.

The Düsseldorf state court convicted the 19-year-old defendant under juvenile law Friday of rape, robbery and bodily harm, news agency dpa reported. The victim was attacked in Düsseldorf on a Sunday in October just after she visited a church.

During the trial, the Moroccan-born man, identified only as Souhayl M. in line with German privacy rules, admitted to committing the attack and said he had been drinking and taking cocaine beforehand. The defendant grew up in Spain, where he was convicted of narcotics and other offenses. He said he came to Germany in 2016 because he risked going to prison in Spain. Investigators used DNA to track him down.
