Man gets 16 years for rape, 4 decades after wife-rape case

SALEM, Ore. (AP) -- An Oregon man convicted of raping two women was sentenced to more than 16 years in prison Friday, almost 40 years after he was acquitted of raping his then-wife in a trial that drew national attention.

Judge Tom Hart sentenced John Rideout to two 100-month sentences, to be served consecutively. He was then led out of the courtroom by a sheriff's deputy, his hands cuffed to a chain around his waist. On Thursday, a jury found Rideout guilty of rape and sodomy.

Both victims spoke before sentencing in the Marion County Courthouse, the same one where Rideout stood trial in 1978.

The Statesman Journal reports that he was the first U.S. man to be tried for raping his wife. The case became a TV movie starring Mickey Rourke and Linda Hamilton.

On Friday, one of the women said, "I am a victim no longer. I am a survivor." The other victim said she wanted Rideout to "get help" and said she held no malice toward him.

Rideout insisted on his innocence as he stood and addressed the court before sentencing. "I am not perfect, but I did not do those things," he said. He pointed out that he had been the subject of a TV movie and had appeared on television talk shows, then complimented his two accusers. "I'm proud of these two ladies," he said, facing them. "They stood up to me." He thanked Hart for allowing him to speak. Hart said it was his constitutional right.

Then, after Rideout was done, Hart spoke before pronouncing sentence. Rideout began interjecting but Hart told him to be quiet, saying he was not having a conversation. The judge then sentenced Rideout to 100 months for each conviction, the mandatory minimum required by a ballot measure approved by Oregon voters in 1994.

In 1978, Rideout was tried for allegedly raping his wife at their Salem apartment in front of their 2-year-old daughter. Rideout was unanimously acquitted in that case. The Oregon Legislature had earlier passed a law eliminating marital privilege as a rape defense.

Rideout and his wife briefly reunited after the trial, but she filed for divorce in March 1979. Rideout said he moved to Northern California and returned to Oregon five years ago to find a wife.

The 2017 trial included testimony from Rideout and the two victims: an acquaintance from his church and an ex-girlfriend, the Statesman Journal reported.

The church acquaintance testified at the trial that she hired Rideout to fix a piece of furniture and help with yard work. She said she thought he was intoxicated and invited him to sleep on her couch instead of bicycling home in the dark. She said goodnight, took her medication and went to bed. "The next thing I knew, he was in my bed," she said. "I kept telling him to stop, but he wouldn't."

Rideout maintained the sex was consensual. The ex-girlfriend testified that Rideout sexually assaulted her three times.

Rape, abuse, death of girls at Guatemala home burned by fire

GUATEMALA CITY (AP) -- When firefighters entered the home for troubled youth, they discovered more than two dozen girls on the floor of a locked room, most of them dead.

A moan rose from one of the bodies, piled on top of each other. When firefighter Danial Perpuac turned the girl over, flames came out of her mouth - she was burning up inside.

"That is something you cannot forget," Perpuac said helplessly. "I know I will have the smell of grilled meat and hair in my nose and throat for life."

The fire on March 8 that killed 40 girls at the Virgen de la Asunciуn Safe Home started when ringleaders took a match to a foam mattress to protest the abuse they had suffered there. Their hell at the government-run shelter began long before the inferno, as documented in several warnings from four different agencies. At least two orders for closure were ignored.

The Virgen de la Asunciуn home is on a hill 14 miles east of Guatemala City. The shelter, protected by high walls and barbed wire, is surrounded by an idyllic pine forest covered with mist every morning. The forest and ravines have offered hiding places for more than 100 children who have escaped what they consider a jail.

About 700 children - nobody knew exactly how many - lived in a home with a maximum capacity for 500. Some dormitories housed more than twice the number of children authorized for the space.

The majority had committed no crime. They were youths sent there by the courts for various reasons - they had run away from home, they were left in the streets, they were abused, they were young migrants. Most came from families so poor they could not afford the $50 in lawyers' fees to get their children out.

Once inside, the children lost out on schooling. Because of a lack of funds, their education was limited to six hours per week in classrooms with up to 80 students.

The abuse at Virgen de la Asunciуn was no secret, and the courts had intervened before. Teacher Edgar Rolando Diйguez Ispache has been in prison since 2013 and is on trial for alleged rape. Another employee, mason Josй Roberto Arias Pйrez, has been in prison since 2014 for raping a mentally disabled girl. He was sentenced to eight years.

Several reports criticizing the shelter were put out by the country's attorney general and the National Adoption System in 2015 and 2016. One recommended the gradual closure of the facility, and another its immediate closure.

Despite the complaints and the reports, the abuse continued.

The story of one girl who escaped the shelter on Oct. 30, after six weeks inside, was told in a case file seen by The Associated Press. The girl, 16, is not named because she is an alleged victim of rape.

She fled from her own house in August to escape the extortion demands by a gang that had been threatening her with rape for a year. On Aug. 13, she told her mother she had had found a job and would be home late. Instead, she ran away to protect herself and her family.

"She hugged me tight that day, tighter than normal," her mother said.

The mother reported her missing daughter to police. On Aug. 22, they located the girl, and a youth court sent her to Virgen de la Asunciуn. Officials separated mother and daughter as they cried.

"Mama, get me out of here," the girl begged, according to her mother.

The shelter did not have a procedure for visits, and they did not see each other for a month. By the time of a hearing on Sept. 13, the girl had been beaten, forced to get a tattoo with the name of a female staffer, and repeatedly raped, her mother said.

The first time, the female staff called her in for a physical exam and sedated her. She woke up and her whole body hurt, and she realized what they had done, according to the case file.

Several days later, they took her to the same place. This time, she was awake and tied to a gurney. The young man who raped her had his face covered.

The third time, it was several men, she said. They raped her and beat her.

A little more than two months after she was sent to the shelter, the daughter escaped along with three others. The girl was afraid to return home because that could mean being sent back to the shelter, but she contacted her brother. The family contacted their lawyer, who filed a motion for habeas corpus.

The lawyer managed to return the girl to her mother, but she didn't reveal all that had happened to her until after the fire. At that point, she said she wanted to testify against her abusers.

On Nov. 11, the state attorney requested that the center be closed. He asked that areas known as "the cage" and "the chicken coop" be closed within 48 hours. Both facilities looked like punishment cells, with metal doors and no windows.

Also in November, a state human rights prosecutor filed a complaint with the Inter American Human Rights Commission charging rampant abuses. The accusations included charges as serious as "forced recruitment for human trafficking for the purpose of prostitution."

There were complaints about sexual abuse by male residents against female residents, including some under 13. One girl was killed in 2013, hanged with a scarf by two other girls.

On Dec. 12, the Sixth Court of Children and Adolescents of the Metropolitan Area condemned the state of Guatemala for violations committed against the rights of minors guarded in the home. It also gave 48 hours to clarify the legal situation of a number of minors inside the home.

Nothing happened.

The secretary of social welfare, Carlos Rodas, who was responsible for the home, appealed the judicial decision. Rodas, who has since been arrested, has denied negligence and refused to resign. He blamed the girls' mutiny on them not liking the food, and said they had sharp weapons hidden in their hair.

"The problem is that judges mix children who have committed crimes with children abandoned by their families," he said. "We ask the Public Prosecutor's Office to investigate but we do not directly blame anyone."

On March 7, about 60 girls escaped from the shelter, as some had done on several occasions before. They rebelled because shelter staff had tried to beat them, said a 14-year-old survivor who had been there three months.

The girl, whose family did not want her name used out of fear for her safety, said she was not raped but officials took away her food. The girls also were made to wake up at 3 a.m. to bathe in cold water, she said.

So the girls jumped from the roof of the facility to the wall, and from there into the trees.

Riot police caught them and returned them to the shelter by force. The police sprayed pepper gas in their mouths and eyes, hit them with batons and kicked them, the 14-year-old told the AP. Police did not comment on the case because of a judicial order that prohibits discussion.

The angry teens waited outside the shelter for hours. They started throwing things at the police. Girls complained that they were abused, attacked and beaten.

The escapees eventually were brought in and locked in a 500-square-foot classroom as punishment. It is as yet unclear who locked them in and who held the key.

By 7:30 the next morning, they had been held for about six hours. They were not let out even to use the bathroom, the girl said.

Four girls who were ringleaders at the home had managed to get matches to smoke cigarettes during their brief escape. In an attempt to protest the lockup and force somebody to open the doors, they set fire to a mattress propped against a window.

The foam stuffing was already coming out of the mattresses because girls used it to fashion pads for menstruation when they didn't have anything else. The burning mattress fell onto other mattresses, and the flames quickly spread.

Locked into the room, the girls shouted, "Help me! Help me!" the 14-year-old said.

Nobody did.

"I saw how they burned, how they screamed, how they died," she said.

She fainted. When she came to, somebody had finally opened the door. She ran out, and the staff doused the girls with water until ambulances arrived.

The girl suffered burns on both arms, a shoulder and part of her face. For many, it was too late. By 9 a.m., 19 of the girls were dead, burned and asphyxiated. Twenty-one more between the ages of 13 and 17 would die at local hospitals over the next few days.

Kimberly Palencia Ortiz was one of the dead. The 17-year-old had been a ward of the state for nearly a year. Her father was in prison, her mother had disappeared, and her grandmother did not have the means to take care of her.

"It is an injustice," Valeria Yojero said tearfully at her granddaughter's burial. "Nobody should die for being poor."

Indian woman cuts off genitals of her alleged rapist

NEW DELHI (AP) -- A 24-year-old woman in southern India cut off the genitals of a Hindu holy man who tried to rape her and who she alleged has been sexually assaulting her for the past eight years, police said Saturday.

G. Sparjan Kumar, a police officer in Thiruvananthapuram, the Kerala state capital, said the woman fled her home after the incident Friday night and called police. The alleged attacker, 54-year-old Gangeshananda Theerthapada, who claims to be a spiritual healer, was reported to be in stable condition after reconstructive surgery.

Pinarayi Vijayan, the state's chief minister, told reporters on Saturday that it was brave of the woman to take such action. "It's a courageous and strong act by the woman," he said.

The New Delhi Television news channel said the woman's family knew Theerthapada, who used to visit their home to cure her bed-ridden father. She told police that he would rape her whenever he got an opportunity. When he again visited her home on Friday night and tried to force himself on her, she got hold of a knife and attacked him, Kumar said.

Violent crimes against women have been on the rise in India despite tough laws enacted by the government.

Child sex convictions spark UK debate about race and abuse

LONDON (AP) -- Britain is wrestling with a volatile nexus of crime, race and religion, after 18 people were convicted of sexually abusing women and girls as young as 15.

One woman and 17 men were convicted of, or admitted, to charges including rape, supplying drugs and inciting prostitution in a series of trials that ended this week at Newcastle Crown Court in northeast England.

The crimes follow a pattern that has become grimly familiar from cases across Britain in the last few years. The convicted men mostly come from South Asian Muslim backgrounds. Their victims - who were plied with drugs and alcohol before being abused at parties, in taxis or in back rooms - are mostly white.

The prosecution of child-grooming gangs in Rochdale, Rotherham, Oxford and now Newcastle has raised uncomfortable questions. Some allege that the crimes were long ignored by authorities afraid they would be branded racist or fearful the allegations might inflame ethnic tensions. Sarah Champion, a British lawmaker from Rochdale, said Thursday that the causes of abuse weren't being tackled "because people are more afraid to be called a racist than they are afraid to be wrong about calling out child abuse."

Ken Macdonald, Britain's former chief prosecutor, said some of the blame lay with particular communities who regarded "vulnerable and disordered young girls (as) just opportunities for sexual abuse." "It is a disease of racism and sexism that will not abate until it is confronted culturally in homes, schools and places of worship as a question of dignity, respect and equal rights," he said.

The recent high-profile cases aren't typical of all child sexual abuse. Most abused children are victimized online, at home or in institutions such as schools, and most of the perpetrators are white men. Police say that in the year to October 2015, 12 percent of offenders in child sexual exploitation cases were from South Asian backgrounds, and 59 percent were white.

But former prosecutor Nazir Afzal, who brought the Rochdale abuse gang to trial, says Pakistani men are disproportionately involved in the sort of "street grooming" seen in Newcastle. He says factors may include sexist attitudes to women and other "cultural baggage," and the large number of South Asian men working in the nocturnal economy. "These young girls are invariably looking for warmth, for transport, for food, for mind-numbing substances," he said. "The predators are hiding among the takeaway workers and taxi drivers."

Some experts say the focus on South Asian perpetrators masks how widespread child sexual abuse is, and overlooks the fact that victims are often ignored by authorities because of their youth and troubled backgrounds. Helen Beckett, an expert on child sexual exploitation from the University of Bedfordshire, said focusing on one ethnic group risked missing other patterns of abuse. "The emphasis that we've had on (abuse) being perpetrated by Asian males means that that is often what we are looking for, and therefore are more likely to find," she said. "We know child sexual exploitation takes so many different forms."

Since the Rochdale case shocked the nation in 2012, police and lawyers have worked hard to prosecute grooming gangs - though some police tactics have drawn criticism. A child welfare group expressed alarm at a police decision in Newcastle to pay a convicted child rapist to act as an informant. Steve Ashman, head of the Northumbria Police force, acknowledged that paying a convicted pedophile "may appear repugnant," but said his information had been crucial to convicting the gang. He said police had "thrown the kitchen sink" at the crime of child sex abuse, deploying 50 officers for more than three years in an operation that has netted 93 convictions, including the ones this week.

Afzal said there had been progress, but that much more needs to be done. "You turn over a stone and you will find this kind of behavior pretty much everywhere in this country," he said. "The demography might change but the behavior remains the same. Where there are available and vulnerable young girls, and boys, there are predators. "There is no community where women and girls are safe. None."

ROME (AP) -- Italian police are investigating the suspected gang rape of a Polish tourist and the savage beating of her partner on Italy's popular Rimini beach.

Italian news reports said the man passed out after being beaten on the head and robbed and his partner was repeatedly raped by four men early Saturday on a secluded stretch of beach in the Adriatic town on Italy's eastern coast. Media reports said the 26-year-old Poles were hospitalized with injuries. Passers-by called police after seeing the couple, bloodied and dazed, on the beach. It wasn't immediately clear if any suspects had been detained.

Rape victim said to ID brothers in Italy beach town attack

ROME (AP) -- Two Moroccan teenagers suspected of being among four males who gang raped a Polish tourist and beat her companion unconscious on an Italian resort beach were identified at a police station Saturday by a Peruvian woman who reported being raped by the same gang shortly after the first attack, according to Italian media. Later, a third suspect, also a minor, was reported detained by police.

Italian state television, the ANSA news agency, and Sky TG24 TV reporting from the Adriatic resort town of Rimini said the two Moroccans, who are brothers, went to their police station after recognizing themselves in footage of surveillance cameras that police released in hopes of finding the attackers. The Peruvian woman, who was attacked on a road not far from the beach, came to the police station in Rimini where she recognized them, the media reports said.

ANSA later reported that a third suspect, described as being a minor of African origin, was detained by police in a nearby town, Montecchio di Pesaro, aided by information provided by the two brothers. The suspects' ages were described as ranging from 15 to 17. The fourth suspect, believed to be of adult age, was being sought by police.

The suspects are a 20-year-old Congolese asylum-seeker, two Moroccan brothers, aged 15 and 17, who were born in Italy and a 16-year-old Nigerian, also reportedly born in Italy. Reports in Poland say a watch belonging to the partner of the raped Pole was found on the Congolese suspect.

The Polish couple returned to their homeland a few days after the attack. They were vacationing in Rimini, whose wide, sandy beaches and night spots make it popular holiday destination. The Polish woman's companion was hit on the head with a bottle, beaten and robbed, according to police. Polish authorities have opened their own investigation of the crimes against their citizens.

Rome's mayor expresses outrage at rape of Finnish woman

MILAN (AP) -- Rome's mayor has expressed outrage after a young Finnish woman was raped in the Italian capital, the latest sexual assault on a foreign woman that has stunned Italians.

Virginia Raggi on Monday tweeted her solidarity with the woman, who was raped near Rome's main train station this weekend. Police arrested a suspect, identified as a 22-year-old from the Bengal region. Police said the man offered the woman a ride as she was waiting for a taxi, before leading her to an isolated street where he threatened to kill her, then raped her. A nearby resident heard the woman's screams and alerted police.

Police in Florence are investigating allegations that two paramilitary policemen raped two American women. A Polish woman was gang raped last month at an Italian beach resort.

Rejected Ghanaian asylum-seeker convicted of rape in Germany

BERLIN (AP) -- A rejected asylum seeker from Ghana has been convicted of raping a camper in Germany.

The dpa news agency reported Thursday the 31-year-old man, whose name wasn't released in line with privacy laws, received 11 ½ years in prison. The man had denied the rape, but the Bonn state court found that DNA evidence clearly linked him to the attack.

The defendant entered Germany from Italy in February after being denied asylum there and his request for asylum in Germany was rejected March 23. Authorities say on April 2 he attacked a couple camping near Bonn with a saw, and raped the 23-year-old woman in front of her boyfriend. The case prompted outrage across Germany, where high-profile crimes committed by asylum-seekers have drawn particular public scrutiny in recent years.

Mexican man illegally took teen from Texas to Georgia for sex

ATLANTA (AP) -- A Mexican man who's in the U.S. illegally took a teenage girl against her will from Texas to Georgia for sex, federal prosecutors said Tuesday.

A Nov. 14 indictment alleges that Andres Castaneda-Guzman, 24, kidnapped a minor and transported her across state lines for the purpose of engaging in unlawful sexual activity. "BJay" Pak said Tuesday in an emailed statement, adding that prosecuting violent crime, including child exploitation, is a top priority for the U.S. Department of Justice.

Castaneda-Guzman went to a party in Terrell, Texas, on Sept. 2 for the upcoming 15th birthday of the teen, who is a distant relative of his, according to statement from a U.S. Department of Homeland Security agent filed in federal court in Atlanta. The teen, who is identified in court documents only by her initials, told an investigator that Castaneda-Guzman had moved to Texas from Georgia in August and that she had been turning down his advances for several weeks, but he had become increasingly jealous and possessive in the days leading up to the party, the agent's statement says. She told the investigator she had no idea Castaneda-Guzman was going to take her to Georgia.

The party, which was held at a family friend's house, was still going around 1 a.m. on Sept. 3, when Castaneda-Guzman offered to take the teen to meet some guests who had been unable to find the party and to help guide them back. Instead, he drove her to Georgia, the agent's statement says. The teen's family noticed she was no longer at the party and reported her missing around 2:30 a.m. Party guests told responding officers the teen had been seen getting into Castaneda-Guzman's black Chevrolet Tahoe SUV. Family members tried unsuccessfully to call Castaneda-Guzman. A friend told the teen's family that Castaneda-Guzman was taking the teen to Jonesboro, Georgia, where he'd lived before, and the family started the drive to Georgia.

The teen told an investigator that they stopped briefly at a trailer park in Jonesboro where Castaneda-Guzman's former in-laws live, the agent's statement says. She said one of the former in-laws caught her trying to use a cellphone to contact her family and removed the battery. Castaneda-Guzman then took the teen to a hotel in Stockbridge on the night of Sept. 3 and forced her to have sex with him, the agent's statement says.

The next day, Sept. 4, Castaneda-Guzman took the teen to the home of one of his friends. After the teen's family and Clayton County police officers both went to the home of Castaneda-Guzman's former in-laws that evening, the in-laws contacted him and said police were looking for the teen. Within minutes, a taxi brought the teen to her family. The taxi driver said he'd picked her up at a home in Forest Park, the agent's statement says. The teen's mother told the federal agent that she'd had no reason to suspect or fear that Castaneda-Guzman would take her daughter and that her daughter did not have permission to leave home with Castaneda-Guzman.
